Judge Blocks Parts of Controversial Arizona Immigration Law

U.S. District Judge Susan R. Bolton, in a lengthy ruling, today granted an injunction against Arizona’s controversial immigration law on the eve of when it was to take effect, effectively blocking enforcement of key parts of the law.

In her ruling, Bolton said that the federal government “is likely to succeed” in a legal challenge to the constitutionality of the new law, particularly the provision allowing police to “make a reasonable attempt to determine the immigration status of a person stopped, detained or arrested.” The ruling also noted that the Arizona law violates separation of state and federal powers by intruding on existing federal laws.

Critics of the new law insist that it will lead to racial profiling.
